Parties

Unless otherwise noted, the term “Red Ogre Review” as used below on this page refers soley to Matthew Bullen DBA Liquid Raven Media and his agents, assignees, successors, and similarly-situated persons and/or entities, as may be relevant.

Site Access

Your access to, and use of, this site and/or any other web properties or online services operated by Red Ogre Review is at your own sole risk. By accessing this site, and/or by sending electronic messages and/or creative work of any kind to Red Ogre Review, you evidence your explicit agreement to these terms of service, voluntarily assume such risk, and waive any claims against Red Ogre Review as may be relevant.

Mature Content

This site’s content is intended solely for consumption by adults of legal age in their relevant jurisdiction(s). If any part of this site’s content is subject to legal restrictions that prohibit your access of such material in your jurisdiction(s), or if you are not of legal age to access this site in your jurisdiction(s), you are prohibited from accessing this site and must immediately stop accessing this site in any manner. The actions of underage individuals who violate these terms of service are the sole responsibility and liability of their parent(s) or legal guardian(s).

No Site Traffic Cookies

To the best of Red Ogre Review’s knowledge, this site’s code does not generate site traffic tracking cookies and does not use any third-party code packages that may track or store user data or any other legally-protected user information; in other words, Red Ogre Review has no ability whatsoever to personally identify anyone who accesses this site.

No Artificial Intelligence Scraping

Red Ogre Review does not consent to the use of any part of this site or its content for artificial intelligence software model training, or any other related purposes. To the best of Red Ogre Review’s knowledge, neither have any of the contributors published on this site.

No Plagiarism

By submitting content of any kind to Red Ogre Review, you affirm, represent, and warrant that your content submission, in whole and in each indiviual part, is your own creative work alone; in other words, no part of the creative work is plagiarized, and the creative work does not contain any material with intellectual property rights to it held by anyone other than you, or otherwise legally protected or restricted material used without appropriate permission.

No Prior Contracts

By submitting content of any kind to Red Ogre Review, you affirm, represent, and warrant that your content submission, in whole and in each indiviual part, is free and unencumbered of any other contracts, claims, or binding agreements that may burden, conflict with, or restrict Red Ogre Review’s use of it; in other words, no other publishers have prior claims to, or hold rights over, the creative work that might conflict with Red Ogre Review’s use of it.

No Fee, No Pay

Red Ogre Review is run by unpaid volunteers. Absent any different, mutual, written agreement, our policy is not to charge a fee for submission of creative work for potential publication; correspondingly, our policy is also not to pay contributors for publishing their creative work with us.

Exceptions for specific projects, such as fundraisers, will be clearly indicated in the relevant call for submissions.

This “no fee, no pay” term of service is non-negotiable.

Permission to Publish

The short summary: Red Ogre Review needs permission to post your creative work to this site, and to do a few industry-standard promotional activities of your creative work on social media, such as posting links to the page(s) on this site that contain that same creative work. This section gives us that permission.

In more detail: this section’s terms apply, in whole and/or individually, as relevant, in the absence of any different, mutual, written agreement.

1.Submissions of creative work of any type to Red Ogre Review are conditioned on, and evidence of, your explicit agreement that in exchange for, and in consideration of, the labor required for Red Ogre Review to evaluate your creative work for potential publication with Red Ogre Review, and in exchange for, and in consideration of, Red Ogre Review’s publication of your creative work, to occur at Red Ogre Review’s sole discretion, you intentionally and unreservedly agree to the following terms.

2.For maximum clarity, before listing those terms and conditions below: you retain all intellectual property rights over your creative work, unchanged and unrestricted by Red Ogre Review, that are not clearly addressed, or obviously implied, by the following terms, to the extent that does not conflict with, or otherwise limit, the enforcement of these terms of service.

3.You intentionally and unconditionally grant Red Ogre Review the permission, license, and/or right to publish your creative work, as may be most applicable to your jurisdiction(s), in the creative work’s original form, and in any reasonable modified or derivative forms; for simplicity, the term “permission” will be used going forward in these terms of service.

4.The primary intent of that permission is to allow the publication of your creative work on this very same site. Since this site is available to the entire Internet, which is available globally, that permission is likewise global in scope.

5.That permission includes posting your work, in whole or in part, to our social media channels and/or to other web properties for the purpose of promoting your creative work, and thereby promoting you as the creator of the work.

6.That permission includes publishing your creative work, as relevant, in whole or in part, in the anthologies of magazine issues that we may provide, at our sole discretion, to you and other contributors as gifts, and/or make available for public sale as fundraising projects.

7.That permission does not have an expiration date and is not intended to be revoked absent a different, mutual, written agreement. In other words, the creative work will remain published with Red Ogre Review without any arbitrary date set for depublishing the creative work, and without any otherwise undiscussed conditions that might lead to the automatic depublication of your creative work, should such a condition occur.

8.That permission is intended to be transferable. If we were to move Red Ogre Review’s content to a new site at some point in the future, for example, that permission includes moving your creative work to that new site, and similar scenarios. If ownership of the site or the press were to change in the future, that permission includes allowing the new owner(s) to take this site’s owner’s place with as few disruptions to the continued and undisturbed publication of your creative work as reasonably possible.

Unanticipated Uses

Any other uses of contributor creative work not explicitly described, or clearly implied, by the preceding terms and explanatory descriptions must be agreed upon in writing ahead of time; for example, in the instance that an inquiry is made by a third-party organization to adapt a contributor’s creative work for inclusion in a new endeavor, such as quoting part of the creative work in a book chapter.

Revocation of Publication

As a courtesy, published contributors may request that their creative work be removed from the Red Ogre Review site and/or any of Red Ogre Review’s social media platforms on written request made to Red Ogre Review’s editors via email sent to info@ogre.red. Assuming that the request is made in good faith and reasonable, and absent any other written agreement(s) or legal obligation(s) to the contrary, Red Ogre Review will, at Red Ogre Review’s sole discretion, make a good faith, diligent effort to depublish the creative work as requested in a timely manner.

Contributor creative work published online that is included in any of Red Ogre Review’s books, such as yearly anthologies of online magazine issues, will only be removed from any copies of said book(s) printed after the time of the request at Red Ogre Review’s sole discretion, or due to a compelling legal reason. Red Ogre Review will not to attempt to recall, or change the contents of, already-printed and distributed books. As a practical matter, doing so is impossible; one reason, among many, is that we have absolutely no way to know who purchases our books via our Amazon.com sales pages.

Red Ogre Review additionally reserves the unrestricted right to revoke publication of, and depublish, any material previously published by Red Ogre Review, on any platform and in any manner, at Red Ogre Review’s sole discretion, and without prior notice, or recompense of any kind, to the creator(s) or rights holder(s) of any such material.

This site and its contents, as well as Red Ogre Review’s social media channels, and any other relevant web properties, are protected by Digital Millenium Copyright Act (17 US Code § 512) safe harbor provisions. Red Ogre Review will depublish any copyright-infringing material upon receipt of a credible, valid, and compliant written notice provided to Red Ogre Review by email at info@ogre.red.

Moral or Natural Rights of Authors

In some jurisdictions, it may be possible for creators to assert “moral rights” or “natural rights” over their creative works. To the extent allowed by the controlling law(s), you voluntarily agree to refrain from asserting any such claims, if doing so would conflict with, or otherwise limit, the enforcement of these terms of service. This section is not directed to potential contributors acting in good faith, but rather intended to prevent bad faith, meritless claims.

For an illustrative example, consider the scenario in which a scammer misleads Red Ogre Review into publishing, unwittingly, plagiarized material. Red Ogre Review later determines that the material was plagiarized, then depublishes it from Red Ogre Review’s site and social media channels. This section is intended to prevent frivolous, abusive, and dishonest claims, such as an individual asserting a claim to the effect of “I think that my jurisdiction’s intellectual property rights system gives me the moral right, or the natural right, to require you to keep publishing the material that I plagiarized, even though your terms of service make it clear that you never intentionally publish plagiarized material.”

Social Media Communications

Red Ogre Review will not acknowledge or respond to divisive comments posted to any social media platform regarding these terms of service and/or Red Ogre Review’s staff, contributors, submission policies, decision to publish or not to publish any given creative work, business practices in general, or similar subjects, without prior written permission from Red Ogre Review. Red Ogre Review reserves the right to refuse service to, revoke publication of, and/or block on social media, without notice, any person who disregards this policy.

This policy is due to prior experience with Internet trolls, and because Red Ogre Review firmly believes in treating everyone in the writing and publishing community with civility, dignity, and respect. The legal purpose of this policy is to prevent social media “trolling” or “griefing” or “brigading” or “dog piling,” meaning the act of posting false, misleading, insulting, abusive, bigoted, harassing, and/or legally defamatory remarks intended to damage, or having the effect of damaging regardless of intent, Red Ogre Review’s social media accounts, business operations, professional relationships with business partners and contributors, and/or professional reputation. This policy applies with equal effect to any social media content directed at social media accounts operated by Red Ogre Review’s staff, contributors, business partners, and/or formally or informally affiliated persons, organizations, or legal entities.

Statements by Third Parties

Simply for clarity, Red Ogre Review has no ability whatsoever to exert any control over what third parties post to their own sites and/or social media accounts; any relevant inquiries must be directed to those persons or organizations alone without Red Ogre Review’s involvement in any way. A classic example would be of a third party publishing an online critical review of a creative work that the author disagrees with as a matter of personal opinion, but that is otherwise not legally objectionable or inappropriate in any manner; in such scenarios, Red Ogre Review has no obligation, and explicitly disavows any obligation, of any kind to make any effort to request, or attempt to require, that the third party change or depublish the disputed material.

Donations

Any monetary, or otherwise valuable, gifts or donations of any kind made to Red Ogre Review by any method are the sole property of Red Ogre Review and, as voluntary gifts or donations made without any expectation recompense of any kind in return, are not refundable or returnable and will not be refunded or returned. Red Ogre Review makes no representations of any kind as to whether any such gifts and donations may or may not be tax-deductible or otherwise provide a beneficial tax outcome to the giver or donor. Any tax or other legal or contractual obligations related to gifts and donations are the sole responsibility of the individual or entity making the same. Red Ogre Review is unable to provide, and will not provide, tax or any other legal advice of any kind regarding any such gifts or donations (or regarding any other matter). If need be, consult with an appropriate professional.

Idemnification

By accessing this site, by submitting content of any kind to Red Ogre Review, and/or by publishing creative work with Red Ogre Review, you unequivocally and without reservation agree to defend, hold harmless, and indemnify Red Ogre Review of any claims that may be brought due to, or in relation to, the same to any degree and in any capacity, whenever any of the same may be asserted by any person or entity.

Reproduction of Intellectual Property

Red Ogre Review’s intellectual property may not be reproduced or used in any manner without the prior written consent of the same. The entirety of this site’s code and site-specific content, taken as a whole, represents a unique, artistic, and creative work owned solely by Red Ogre Review, completely independent of the individual creative works provided by contributors.

No Ongoing Relationship

The extent of the contractual interaction between you and Red Ogre Review is defined solely by these terms of service and limited to the above-described purposes alone. Submitting creative work to, publishing creative work with, and/or simply communicating in any manner with Red Ogre Review does not create, and does not imply the creation of, any type of ongoing literary agent-author, literary editor-author, business, employment, independent contractor, fiduciary, attorney-client, or other relationship of any kind between you and Red Ogre Review absent a different, mutual, written agreement.

Only Matthew Bullen DBA Liquid Raven Media has the legal right and capacity to enter into legally-binding agreements on Red Ogre Review’s behalf. Unless otherwise explicitly agreed to in writing, Red Ogre Review’s editors, staff, volunteers, agents, assignees, and similarly-situated persons and/or entities, cannot do so. Any representations to the contrary by any person or entity are on their face null and void.

Reservation of Undiscussed Rights

Red Ogre Review reserves all rights in their entirety that have not been discussed by these terms of service.

Open Source Code

Thanks for the free and open source code from which this site was built are due to Henk Verlinde. Any other site code created by Red Ogre Review is the sole property of the same and may not be reproduced or used in any manner without Red Ogre Review’s prior written consent.
