Parties#

Unless otherwise noted, the term “Red Ogre Review” as used below on this page refers soley to Matthew Bullen DBA Liquid Raven Media and his agents, assignees, successors, and similarly-situated persons and/or entities, as may be relevant.

Site Access#

Your access to, and use of, this site and any and all other web properties and services operated by Red Ogre Review is at your own sole risk. By accessing this site and/or by sending electronic messages and/or content submissions of any kind to Red Ogre Review, you evidence your explicit agreement to this list of terms and waive any claims against Red Ogre Review and Red Ogre Review’s editors, staff, volunteers, agents, assignees, and similarly-situated persons and/or entities, as may be relevant.

Minimum Age#

You must be at least eighteen years of age to access this site and to send content submissions or any other type of communication to Red Ogre Review. The actions of users under the age of eighteen who violate these terms are the sole responsibility and liability of their parent(s) or legal guardian(s).

Mature Content#

This site contains mature content intended solely for consumption by adults of legal age in their relevant jurisdiction(s). If any part of this site’s content is subject to legal restrictions that prohibit your access of such material in your jurisdiction(s), you are prohibited from accessing this site.

Tracking Cookies#

To the best of Red Ogre Review’s knowledge, this site’s code does not generate tracking cookies and does not use any third party code packages that may track or store user data or any other legally-protected user information.

Content Licensing#

Content submissions of any type to Red Ogre Review are conditioned on, and evidence of, your explicit agreement that in exchange for Red Ogre Review’s evaluation of your content submission for potential publication with Red Ogre Review or any other publication outlet, you intentionally and unreservedly grant Red Ogre Review an unrestricted, transferable, and nonrevocable worldwide license and right to use the submission content on this site and in any reproduced, related, or derivative materials, including in print books and in electronic books produced by Red Ogre Review, and on social media channels operated by or affiliated with Red Ogre Review, without expectation of any cash payment, royalty payments, or any other valuable compensation; you also irrevocably waive in their entirety any current or future exercise of “natural rights” or “moral rights of authors” as may potentially be asserted.

Sole Creative Work#

By submitting content of any kind to Red Ogre Review, you affirm, represent, and warrant that your content submission, in whole and in each indiviual part, is free and unencumbered of any other contracts, claims, or binding agreements that may burden, conflict with, or restrict Red Ogre Review’s use of it.

Digital Millenium Copyright Act#

This site and its contents, including Red Ogre Review’s Mastodon platform at talk.ogre.red, are protected by Digital Millenium Copyright Act (17 US Code § 512) safe harbor provisions. Red Ogre Review will depublish any copyright-infringing material upon receipt of a credible, valid, and compliant written notice provided to Red Ogre Review by email at info@ogre.red.

Revocation of Publication#

Red Ogre Review further reserves the unrestricted right to revoke publication of, and depublish, any material previously published by Red Ogre Review, on any platform and in any manner, at Red Ogre Review’s sole discretion and without prior notice or recompense of any kind to the creator(s) or rights holder(s) of any such material.

Donations#

Any monetary, or otherwise valuable, gifts or donations made to Red Ogre Review are the sole property of Red Ogre Review and, as voluntary gifts or donations made without any expectation recompense of any kind in return, are not refundable or returnable and will not be refunded or returned. Red Ogre Review makes no representations of any kind as to whether any such gifts and donations may or may not be tax-deductible or otherwise provide a beneficial tax outcome to the giver or donor. Any tax or other legal or contractual obligations related to gifts and donations are the sole responsibility of the individual or entity making the same. Red Ogre Review is unable to provide, and will not provide, tax or any other legal advice of any kind regarding any such gifts or donations (or regarding any other matter). If need be, consult with an appropriate professional.

Idemnification#

By accessing this site, or by submitting content of any kind to Red Ogre Review, you unequivocally and without reservation agree to defend, hold harmless, and indemnify Red Ogre Review of any claims that may be brought due to, or in relation to, the same to any degree and in any capacity, whenever any of the same may be asserted by any person or entity.

Intellectual Property Ownership#

Red Ogre Review’s intellectual property is owned solely and in its entirety by Matthew Bullen DBA Liquid Raven Media and may not be reproduced or used in any manner without the prior written consent of the same.

Legal Agreements#

Only Matthew Bullen DBA Liquid Raven Media has the legal right and capacity to enter into legally binding agreements between Red Ogre Review and third parties. Unless otherwise explicitly agreed to in writing, Red Ogre Review’s editors, staff, volunteers, agents, assignees, and similarly-situated persons and/or entities, cannot do so. Any representations to the contrary by any person or entity are on their face null and void.
